Gigs App - Terms of use
Last updated: 5 May 2026These Terms of Use ("Terms") govern your access to and use of the Gigs mobile application, website, and related services (collectively, the "App" or "Platform"), operated by Gigs App ("Gigs", "we", "us", or "our").By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.## 1. Overview of the Gigs AppGigs is a marketplace platform that connects people who want to book services ("Buyers") with independent service providers ("Sellers") in South Africa.We do not employ Sellers. They are independent contractors, not our employees, partners, or agents.No digital or online services are supported at this time. All services are in-person, and Sellers are responsible for fulfilling services at the location specified by the Buyer.The App currently focuses on the following service categories only:- Photography
- Tutoring
- Female Beauty
- Male GroomingAny service that does not fall within these categories is not allowed on Gigs.## 2. Eligibility and Accounts### 2.1 Age requirementsYou must be at least 13 years old to create and use a Buyer account on the App.If you are under 18, you confirm that you have obtained permission from a parent or legal guardian, and that they accept these Terms on your behalf.You must be at least 18 years old to create, operate, or receive payouts through a Seller account.By using the App, you represent and warrant that:- You meet the age requirements for the type of account you use;
- You have the right, authority, and capacity to agree to and comply with these Terms; and
- Any information you submit to us is accurate and up to date.### 2.2 Account registrationTo use certain features of the App, you must create an account and provide accurate, current information. You agree to:- Keep your login credentials secure and confidential.
- Not share your account with others or allow others to use your account.
- Promptly update your information if it changes.You are responsible for all activities that occur under your account.## 3. Role of Gigs App### 3.1 Marketplace onlyGigs provides a platform where Buyers and Sellers can find each other, communicate, arrange bookings, and process supported payments.We do not provide or perform the actual services listed on the App.Sellers are solely responsible for the services they offer and provide.Buyers are solely responsible for choosing Sellers and for any arrangements made with them.Any agreement for services is directly between the Buyer and the Seller, not between the user and Gigs.### 3.2 No employment relationshipNothing in these Terms creates an employment, agency, partnership, or joint venture relationship between Gigs and any user. Sellers act as independent contractors and are fully responsible for complying with all applicable laws, including tax obligations.## 4. Permitted and Prohibited Services### 4.1 Allowed categories (for now)The Platform is currently limited to the following categories:- Photography
- Tutoring
- Female Beauty
- Male GroomingSellers must only offer services that clearly fall within these categories.### 4.2 Prohibited servicesThe following are strictly prohibited on Gigs:- Adult content or adult services of any kind.
- Illegal services or services that facilitate illegal activity.
- Services related to drugs, weapons, or gambling.
- Any service that does not fall within the allowed categories specified above.
- Any service that violates applicable laws or regulations in South Africa.We may remove any service, profile, or content that we reasonably believe falls outside these categories or appears unsafe, illegal, fraudulent, or otherwise inappropriate.## 5. User Conduct and Community RulesYou agree not to:- Harass, abuse, threaten, or intimidate any person.
- Engage in hate speech or discrimination based on race, gender, religion, nationality, disability, or any other protected characteristic.
- Engage in fraud, scams, or deceptive behaviour, including:
- Fake bookings
- Misleading profiles or gig descriptions
- Misrepresenting your skills, qualifications, or identity
- Offer or request illegal services or use the Platform for any unlawful purpose.
- Post or share any content that is:
- False or misleading
- Illegal or harmful
- Violent, obscene, or offensive
- Interfere with the operation of the App, including:
- Hacking or attempting to gain unauthorised access
- Using bots, scrapers, or other automated tools without permission
- Introducing malware or harmful code
- Pressure users to pay off-platform where that would bypass supported platform controls or applicable rules.Any behaviour that does not align with these Terms may result in warning, content removal, booking cancellation, suspension, account restriction, or account termination.## 6. Content and Intellectual Property### 6.1 Your contentUsers may upload or submit content, including:- Profile information and photos
- Gig descriptions and pricing
- Reviews and ratings
- Messages and other materialsYou remain the owner of your content, but by posting it on the App you grant Gigs a non-exclusive, worldwide, royalty-free, sublicensable and transferable licence to:Use, display, host, store, reproduce, modify, and distribute your content in connection with operating, promoting, and improving the Platform (for example, showing your gig in search results, marketing sections, or featured listings).You represent and warrant that:- You have all necessary rights to the content you upload.
- Your content does not infringe any third-party rights or violate any laws.### 6.2 Our contentThe App and all related content, including logos, branding, design, and software, are owned by or licensed to Gigs and are protected by intellectual property laws. You may not:Copy, modify, distribute, or create derivative works based on the App or its content, except as allowed by these Terms or with our prior written permission.## 7. Bookings, Payments and Fees### 7.1 Booking processBuyers can browse services and submit booking requests to Sellers. A booking is considered confirmed when:- The Buyer has submitted a booking request; and
- The Seller has accepted the request through the App.Sellers are responsible for fulfilling accepted bookings at the location specified by the Buyer.### 7.2 Payment methodsGigs currently supports:- Cash payments, made directly between the Buyer and Seller at the time of service; and
- Card payments, processed through a third-party payment provider, currently Paystack.Card payments are processed by Paystack (or any future payment partner), not by Gigs directly.### 7.3 Platform and transaction feesTransaction fees charged by Paystack are paid by the Seller and are deducted from the amount paid by the Buyer.Gigs may also charge service or platform fees to Sellers, which will be clearly disclosed in the App (for example, as a percentage of the booking or as fixed fees).Any applicable fees will be shown to Sellers before they accept a booking.### 7.4 Cancellations and refundsBuyers may cancel a booking at any time, except when:- The service is already in progress; or
- The service has already been fulfilled or completed.Sellers may cancel a booking at any time, but repeated or abusive cancellations may lead to warning, suspension, or termination of their account.Gigs may facilitate refunds, reversals, or payment adjustments in limited circumstances, including eligible booking deposit scenarios, duplicate or failed payment scenarios, fraud or misuse investigations, no-show outcomes, or where required by law, card network rules, or payment processor requirements.Not every service complaint qualifies for a refund, and some disputes may still require direct engagement between the Buyer and the Seller.Because Gigs is not the provider of the underlying in-person service, Gigs may distinguish between:- payment and platform issues that we can review directly; and
- service quality or performance disagreements that may depend on the facts provided by the Buyer and Seller.## 8. Disputes Between UsersIf a problem arises, for example quality of service, no-shows, late arrivals, harassment, fraud, property damage, impersonation, or off-platform payment abuse, users should first try to resolve the issue directly where appropriate.Gigs also operates trust and safety, dispute-review, and moderation processes. We may review complaints, booking records, in-app communications, verification records, and other relevant platform evidence to assess reports and take appropriate action.Depending on the case, Gigs may:- warn or restrict an account;
- suspend or block an account;
- cancel a booking;
- review eligibility for a booking-deposit refund or settlement outcome;
- request more information from the parties involved; or
- take other reasonable platform or safety actions.Gigs does not act as a court or a guaranteed arbitration service, and we do not promise a particular outcome in every dispute, especially where a complaint is subjective or evidence is limited. However, we do actively review safety, fraud, misconduct, and eligible payment-related disputes on the Platform.## 9. Safety, Verification, Screening, and Assumption of Risk### 9.1 Verification and screeningTo help protect the Platform, Gigs may carry out identity verification, document and selfie review, payout account validation, manual compliance review, service eligibility checks, trust and safety screening, background checks, and other enhanced due diligence measures where reasonably appropriate, required by law, or required by our payment, banking, or compliance partners.Approval to use the Platform does not guarantee that a user will never engage in harmful conduct, but verification and screening are part of our efforts to reduce risk and improve trust on the Platform.### 9.2 Your responsibility and riskBecause services happen in-person and often in private or semi-private locations, users should act carefully and take reasonable safety precautions.You are responsible for your own choices, including:- where you meet;
- who you choose to work with; and
- any precautions you decide to take.While Gigs may apply verification, screening, moderation, and platform safeguards, we cannot guarantee the conduct of every user or the outcome of every in-person interaction.## 10. Beta Status and Changes to the AppThe Gigs App is currently in an early or beta stage. This means:- Features, design, and functionality may change frequently.
- The App may contain bugs, errors, or interruptions.
- Some features may be launched, modified, or removed without prior notice.We may update, suspend, or discontinue any part of the App at any time.## 11. Third-Party Services and LinksThe App may use or integrate with third-party services, including:- Payment providers (e.g. Paystack)
- Map and location services (e.g. Google Maps)
- Push notification providers
- Analytics providers
- Hosting, authentication, and other infrastructure servicesYour use of these services may be subject to additional terms and privacy policies of those third parties. Gigs is not responsible for the content, terms, or policies of third-party services.## 12. Account Suspension and TerminationWe may suspend, restrict, or terminate your access to the App, with or without notice, if:- You violate these Terms or any policies referenced in them.
- You engage in behaviour that we consider harmful, unsafe, fraudulent, abusive, or misleading.
- You repeatedly cancel bookings in bad faith or are frequently reported by other users.
- You fail verification, screening, compliance, or payout review requirements.
- We believe your continued use of the App creates risk for Gigs, other users, our service providers, or our compliance obligations.You may stop using the App and request account deletion at any time (subject to any legal or legitimate business need for us to retain certain data, as explained in the Privacy Policy).Termination of your account does not remove your responsibility for obligations that arose before termination (for example, unpaid fees or legal obligations).## 13. Disclaimer of WarrantiesTo the fullest extent permitted by law:- The App and all content and services are provided on an "as is" and "as available" basis.While Gigs uses reasonable efforts to operate the Platform reliably and to apply safety and compliance controls, we do not warrant that:- The App will be uninterrupted, secure, or error-free.
- Any information or content on the App is accurate, complete, or up to date.
- Any particular service outcome or booking will meet your expectations.## 14. Limitation of LiabilityTo the fullest extent permitted by South African law:Gigs and its directors, employees, and affiliates shall not be liable for:- Any indirect, incidental, special, consequential, or punitive damages.
- Any loss of profits, revenue, business, data, or goodwill.
- Any personal injury, property damage, or other harm arising out of:
- Your use of the App
- Your interactions with other users
- Any in-person meetings or services arranged through the AppTo the extent we can be held liable, our total liability to you for any claim arising out of or relating to the App or these Terms will be limited to the total amount of fees (if any) you paid to Gigs through the App in the six (6) months immediately before the event giving rise to the claim.Some laws may not allow certain limitations of liability. In such cases, these limitations apply only to the extent allowed by law.## 15. IndemnityYou agree to indemnify and hold harmless Gigs and its directors, employees, and affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:- Your use of the App;
- Your violation of these Terms;
- Your violation of any law or third-party right; or
- Any service you provide or receive through the App.## 16. Changes to These TermsWe may update or modify these Terms from time to time. When we do:- We will update the "Last updated" date at the top of this document; and
- We may provide notice within the App or by email where appropriate.If you continue to use the App after the updated Terms become effective, you are deemed to have accepted the changes. If you do not agree with the new Terms, you must stop using the App and may request account deletion.## 17. Governing Law and Dispute ResolutionThese Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.You agree that:- Before taking any formal legal action, you will first contact us at [email protected] to attempt to resolve the issue informally.
- If we cannot resolve the dispute informally within a reasonable time, any dispute, claim, or controversy arising out of or related to these Terms or your use of the App shall be submitted to the courts of South Africa, with primary venue in or near Potchefstroom, North West Province, unless another venue is required by law.## 18. MiscellaneousEntire Agreement: These Terms constitute the entire agreement between you and Gigs regarding the App.Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.No Waiver: Our failure to enforce any right or provision in these Terms shall not be considered a waiver of that right or provision.Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction, in connection with a merger, sale, or other corporate transaction.## 19.
